We understand that discovering a creator has left Fanvue, or that their content has been removed, can be frustrating, especially if you are an active subscriber or have made purchases. This article explains your rights in this situation and what options are available to you.
What happens when a creator's account is terminated?
If a creator's account is terminated, whether they chose to close it, their account was suspended, or Fanvue removed it for policy reasons, access to their profile, posts, and all associated content is immediately removed. This applies to:
Content included in a subscription
Pay-per-view posts and media previously purchased
Content sent to you in direct messages
Your message history with the creator will no longer be accessible. Any active subscription to that creator will be automatically cancelled - no further payments will be taken from the point of termination.
This is governed by T&Cs Section 16.4, which states that upon account termination, access to paid-for services, content, and features is immediately revoked.
What if a creator deletes individual posts or content?
Creators can delete individual posts or media at any time. If content you have paid for (for example, a pay-per-view post) is deleted by the creator, you will no longer be able to access it.
Do I own the content I have purchased?
No. Purchasing a subscription, pay-per-view post, or any content on Fanvue gives you the right to access and view that content - it does not transfer ownership, copyright, or any intellectual property rights in the content to you.
Creators retain full intellectual property rights over everything they produce and publish on Fanvue (T&Cs Section 10.2). This means creators have the right to remove, modify, or discontinue their content at any point, regardless of whether it has been purchased. Fanvue's Terms & Conditions (Section 4.2) grant the platform a licence to host and deliver that content, but ownership stays with the creator.
How the UK and EU law treats digital content
Under the UK Consumer Rights Act 2015 (Chapter 3 - digital content) and EU Consumer Rights Directive 2011/83/EU, Article 16(m), purchasing access to digital content does not confer ownership of that content, and the right of withdrawal is limited once content has been delivered.
Does this apply to AI-generated content?
Yes, the same principles apply to AI-generated content on Fanvue. Purchasing access to AI-generated images, messages, or other media does not give you any rights over the underlying AI model, the content itself, or any of its outputs. AI creators on Fanvue operate under the same T&Cs as human creators in this regard.
Am I entitled to a refund if the content I paid for has been removed?
No. If a creator removes their content or terminates their account, this does not entitle you to a refund. All payments on Fanvue are non-refundable (T&Cs Section 3.12). When you purchase a subscription or pay-per-view content, you are paying for access to that content at the point of purchase - not for permanent, indefinite access. If you were able to view the content before it was removed, the service has been delivered, and no refund applies.
Any exceptions?
If you were charged and were genuinely unable to access the content at all before it was removed, contact our support team at [email protected] within 30 days of the transaction (T&Cs Section 3.17), and we will review your case. As proof that you were unable to access the content, please make sure to include the screen recordings/screenshots. Refunds in these circumstances are considered at Fanvue's discretion and are not guaranteed.
